Terms
These terms cover the software sold and given away at dphms.org. By downloading or buying, you accept them. They are written to be read, not to hide anything.
1. Who you are dealing with
DPHMS - Doctor Power House Mobile Solutions, owned and operated by Richard Carmen Anicola. Contact: 4ranicola@gmail.com. The site is dphms.org.
2. What you are licensed to do
You get a personal, non-exclusive, non-transferable licence to install and use the apps on devices you own or control. You may not resell, sublicense, rent, rebrand or redistribute them, publish them on a store or mirror, or ship them inside another product. The APKs are signed with house key 7746675e; a build with any other signature is not ours and is not covered by these terms.
3. Prices, payment and delivery
Prices are shown on the store in US dollars and are one-time, not subscriptions. Payment is taken by PayPal. After payment you are returned to a delivery page that decrypts your link in the browser; the file itself is served from a content-hashed name that only that link reveals.
Delivery links expire after 30 days and are issued per purchase, so re-download by asking for a fresh link with your receipt. Treat the link as the thing you paid for: posting it publicly lets anyone spend it while it lasts.
One limit remains, and it is PayPal's, not ours to wave away: until the store runs with payment data transfer enabled, the amount travels in the payment request, so the price is enforced by PayPal's records rather than by this page. When verification is on, the same endpoint refuses a short payment instead of delivering.
Your licence is for you, not for the link. Sending a delivery link to someone else is redistributing the app, which section 2 does not allow.
4. Refunds
If an app does not work on your device, write to us within 14 days of purchase with your PayPal transaction identifier and a description of what happened. The owner reviews each request and answers with a decision. Nothing here limits a right you have under the consumer law that applies to you.
5. What the software does to your device
This is the part to actually read. The apps run commands as the Android shell user, uid 2000, with no root and no unlocked bootloader. They can change system settings, network and radio configuration, permissions and app state on your device, because that is what you are buying them to do.
- Changes can affect connectivity, battery behaviour, notifications and other apps.
- Some settings are not exposed by every vendor build. The apps report what they could not do rather than pretending.
- You are responsible for what you run on your own hardware. Back up anything you care about.
- Nothing here is designed to elevate beyond the shell user, and the house does not ship root paths.
6. No warranty
The software is provided as is, without warranty of any kind, express or implied, including fitness for a particular purpose or non-infringement. The house tests against signed APK bytes and real devices where it can, but a vendor ROM can behave in ways no build can predict. The paper at /paper.html states the limits in public, including that one Tunnel means one transport for the whole house.
7. Limitation of liability
To the maximum extent permitted by law, the owner is not liable for indirect, incidental or consequential loss, loss of data, loss of profit or device malfunction arising from use of the software. Where liability cannot be excluded, it is limited to the amount you paid for the app in question.
8. Free apps
Tunnel and IWO are free. They are covered by sections 2 and 5 through 7 the same as paid apps, minus the payment parts.
9. Support and updates
Support is by email at the address above. Updates are published at dphms.org and announced in the RSS feed. There is no obligation to provide updates for any particular period, and no subscription that could lapse.
10. Acceptable use
Do not use the software to break the law, to interfere with devices you do not own, or to circumvent another product's licensing. The house tools are for making your own phone obey you.
11. Changes to these terms
The date at the top changes when these terms change, and material changes are announced in the feed and on the forum. The terms in force at the time of your purchase are the ones that apply to that purchase.
12. Governing law
[OWNER TO COMPLETE: governing law and venue for your state and country.] This is the one line these terms leave for the owner to set, because inventing a jurisdiction on your behalf would be worse than leaving it visible. Until it is filled in, disputes will be handled in good faith by email first.
